Terms & Conditions

By creating an account, accessing, or using the EZResident mobile application, website, and related services (collectively, the “Services”), you (“User,” “you”) agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy, which is incorporated by reference.

You must be at least 18 years old to create an account. Where a feature is used by or on behalf of a person under 18 (for example, a family member profile), a parent or legal guardian must provide verifiable consent and remains responsible for that use.

EZResident may require additional verification steps to confirm such consent prior to account activation or feature enablement.

You are responsible for:

• Providing accurate, current, and complete information during registration and profile setup.
• Keeping your login credentials, passwords, and OTP verification codes confidential and secure.
• Promptly reporting any unauthorized access, suspicious transactions, or suspected security breach of your account.

You are responsible for all activity that occurs under your account, except to the extent caused by EZResident's own negligence or breach of these Terms.

You agree to use the Services only for lawful purposes connected with residential community management and agree not to:

• Provide false, misleading, or impersonated information.
• Attempt to gain unauthorized access to the Services, other accounts, or Society data.
• Upload viruses, malware, or other harmful code.
• Interfere with or disrupt the integrity or performance of the Services.
• Use the Services for any unlawful, fraudulent, or harassing purpose.
• Scrape, reverse-engineer, or extract data from the Services except as permitted by these Terms.

Users must communicate respectfully with other residents, Society management, security staff, and Service Providers.

Harassment, abusive language, threats, discrimination, defamation, or unlawful conduct may result in content removal, account suspension, or termination, and may be reported to appropriate law enforcement authorities where required by law.

EZResident may enable residents to discover or connect with third-party Service Providers:

• EZResident does not vet, guarantee, employ, or supervise Service Providers unless expressly stated otherwise for a specific verified feature.
• EZResident is not a party to, and is not responsible for, any agreement, payment, dispute, workmanship, or outcome between a User and a Service Provider.
• Users are solely responsible for verifying credentials, licenses, and suitability of any Service Provider before engaging them.

Where the Services include payment features (e.g., maintenance dues, clubhouse bookings, service bookings):

You retain ownership of Content you upload (complaints, notices, documents, visitor details, etc.).

By uploading Content, you grant EZResident a limited, non-exclusive, royalty-free license to host, store, process, transmit, and display that Content solely to operate and provide the Services.

You must not upload unlawful, defamatory, obscene, or infringing content, or content you do not have the right to share (e.g., another resident's personal data without a lawful basis).

EZResident may remove Content that violates these Terms or applicable law and, where legally required, report such Content to authorities.

All software, trademarks, logos, designs, and other intellectual property comprising the Services are owned by EZResident or its licensors. Except for the limited right to use the Services as intended, no other rights are granted.

You may not copy, modify, distribute, sell, or reverse-engineer any part of the Services without prior written permission from EZResident.

We aim to provide reliable Services but do not guarantee uninterrupted, timely, secure, or error-free operation. Scheduled maintenance, updates, or events beyond our reasonable control (see Section 16) may affect availability.

We may modify, suspend, or discontinue features with reasonable notice where practicable.

EZResident may suspend or terminate an account, with notice where practicable, if a User:

• Violates these Terms;
• Engages in fraudulent, unlawful, or harmful activity;
• Poses a risk to the security, integrity, or availability of the Services or other users.

Users may request deletion of their account at any time, subject to Section 6 of the Privacy Policy (Data Retention) and any Society-level record-keeping obligations.

To the maximum extent permitted by applicable law:

• EZResident's total aggregate liability arising out of or relating to the Services shall not exceed the amount, if any, paid by the User to EZResident for the Services in the twelve (12) months preceding the claim (or ₹5,000 if no amount was paid), except where such limitation is not permitted by law.
• EZResident shall not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or business opportunity, arising from use of the Services.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including liability arising from EZResident's fraud, gross negligence, or willful misconduct.
• EZResident is not liable for the acts, omissions, or defaults of Societies, residents, or third-party Service Providers.

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation, failing which it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement, seated in Gandhinagar, Gujarat, with proceedings conducted in English.

Subject to the foregoing, the courts at Gandhinagar, Gujarat shall have exclusive jurisdiction.
